Common Reasons for Rejection of SASSA Application

Learn how to appeal a declined application. Several factors could be contributing to disapproval. The primary ones include:

  1. Unfair Decision: You feel that you were right (in meeting the eligibility criteria for the SRD), and the first rejection made a mistake.
  2. Changed Circumstances: Perhaps it’s been a while since you applied which didn’t meet the current conditions. No need to worry about it, we’ll help you.
  3. Missing Information: There may have been missing information on your application that you didn’t provide correctly in the Application Form.

What happens after Submitting the Appeal?

  • Wait for the Outcome: Be patient while the Independent Tribunal for Social Assistance Appeals (ITSAA) reviews your Sassa Grant application.
  • Final Decision: The ITSAA’s decision is final.
  • Judicial Review: If you are still not satisfied after the Petition outcome, your final option is to Request a judicial review in the high court within 180 days of receiving the Plea decision.

How Long does Appeals usually Take

In a Social Relief of Distress grant appeal, the Independent Tribunal for Social Assistance Appeal’s (ITSAA) should finalize its decision within 60 to 90 days of receiving the appeal. The SRD Application submission process is no longer managed by South African Social Security Agency (SASSA) but instead the Independent Tribunal.

SASSA SRD Appeal Timeline

  1. Appeal Submission: If your application is Declined, send your appeal to the Department of Social Development (DSD) Independent Tribunal within 30-90 days after you receive a rejection letter. You will need to file a separate appeal for each month you were turned down.
  2. Process to apply for Reconsideration: ITSAA revisits the appeal and reconsiders SASSA’s decision. This can be a period from sixty to ninety days.
  3. Notification of outcome: ITSAA will communicate the outcome to you electronically using SMS.
  4. When you get Paid: If you win your SASSA’s appeal, benefits are paid retroactive to the month in which you first applied. Also, R370 or R350 Grant payment will be released as well.

Can I Appeal more than once?

In general, you cannot appeal the same SASSA decision more than once. However, the process for the Social Relief of Distress (SRD) R350 grant allows for a monthly appeal for each month that your application was rejected. For all other social grants, a tiered process provides different stages of recourse.

After Exhausting Grant Appeals

If you have gone through all appeal stages and your Reapplication is still denied, you generally cannot lodge an appeal again based on the same application.

However, you can:

  • Submit a new application: If your circumstances change and you believe you now qualify Requirements, you can submit a completely new Grant application.
  • Request a judicial review: In some cases, your final option may be to approach the High Court for a judicial review, though this is a complex and often costly process.

Note:

Please keep in mind that an appeal application should be submitted for each month in which a person is denied by SASSA, if they disagree with the decision.
